Rhea Chakraborty has been granted relief after a special NDPS court ordered the defreezing of her and her brother Showik Chakraborty’s bank accounts, citing lapses by the Narcotics Control Bureau.
ACCOUNTS TO BE DEFROZEN
The accounts were frozen in 2020 during the NCB’s probe into an alleged drug trail linked to the death of Sushant Singh Rajput.
Allowing the plea, the court said the freezing could not be sustained due to non-compliance with mandatory legal provisions.
COURT FLAGS PROCEDURAL FAILURE
The court noted that under the NDPS Act, any order to freeze property must be confirmed by a competent authority within 30 days.
As no such confirmation was obtained in this case, the court held the action to be legally invalid.
DEFENCE VS PROSECUTION
The defence argued that due process was not followed and the accounts were frozen without the required approvals within the stipulated time.
The prosecution opposed the plea, claiming the action was justified and citing alleged links to a drug network.
However, the court dismissed these arguments, stressing that statutory requirements cannot be bypassed.
CASE BACKGROUND
Rhea Chakraborty was arrested in September 2020 on drug-related charges in connection with the case and spent 28 days in custody before being granted bail.
