CBI Objected, Victim Warned, Yet Kuldeep Sengar Secured Interim Bail Four Times.
Kuldeep Singh Sengar, the former BJP MLA convicted in the Unnao rape case, walked out of jail four times over the past three years on interim bail — for his daughter’s wedding, his cataract surgery, and medical issues including diabetes, anxiety, and spinal problems.
Despite strong objections from the CBI and the victim, Sengar relied on these prior bails to argue before the Delhi High Court that he was not a threat to the victim’s family.
Timeline of Interim Bails
27 Jan – 1 Feb 2023: Daughter’s wedding. The victim raised security concerns; Sengar returned briefly on 1 Feb before attending the wedding on 8 Feb.
6 – 10 Feb 2023: Second stint for wedding arrangements.
11 – 20 Dec 2024: Medical bail for multiple health issues. AIIMS confirmed he was stable and fit for outpatient care, though hospital officials flagged large numbers of visitors affecting treatment.
23 – 24 Dec 2024: Cataract surgery at AIIMS.
In total, Sengar was granted 23 days of interim bail.
Court’s Decision on Permanent Bail
On 23 December 2025, the Delhi High Court permanently suspended Sengar’s sentence, stating that fears for the victim’s safety were insufficient to justify continued custody. The court termed the threat perception argument “not tenable.”
Sengar highlighted his previous bail record to strengthen his claim, showing the court that he had not misused his liberty earlier.
Background
During his AIIMS stay, the hospital noted an unusually high number of visitors, raising security concerns. Nevertheless, the court repeatedly approved Sengar’s bail, balancing medical and personal reasons against objections from the victim and investigative authorities.
This sequence of interim releases has sparked debate over judicial discretion and victim safety, as Sengar leveraged these short-term bails to argue for permanent relief.
